2. Products and Orders
a. Product Descriptions: Pooldawg makes every effort to assure that product descriptions on our website are accurate, complete and up to date however, sometimes manufactures change things up that we may not be aware of at the time. As such, we make no representations to the completeness or correctness of any information on the website. All product descriptions, specifications, and prices are subject to change at any time without notice. Certain weights, size measurements, and similar descriptions are approximate and may be slightly different within reasonable tolerances.
b. Product Images: We make every effort to display the products and their colors as accurately as possible. However, the actual colors you see will depend on your monitor, and we cannot guarantee that your monitor's display of any color will be accurate. In addition, wood grain and wood stains pictured are a depiction of the actual product used for display. The actual product may vary slightly in this regard.
c. Pricing and Availability: All prices are in US Dollars. We do not guarantee that all products will be in stock at all times. In the event a product is out of stock after you have placed an order, we will notify you and you will be given the option to wait for the product to become available, substitute it for another product, or receive a full refund. The inclusion of any product on the website does not imply or warrant that these products will be available at any time.
In addition, we reserve the right to limit order quantities or refuse/cancel orders to any customer including, but not limited to, pricing errors and excessive order returns. All prices and availability is subject to change without prior notice.
d. Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.
e. Mistakes: In the event a product is listed at an incorrect price due to typographical error or error in pricing information, we shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price.
3. Shipping and Delivery
a. Shipping: We ship to addresses within the United States and internationally. Shipping costs will be calculated at checkout and are based on the weight, dimensions, and destination of your order.
Pooldawg does not charge U.S. taxes on orders shipping to other countries and is not responsible for any customs handling fees, duties, or taxes that result when your order is imported to your county. You will be the importer and will be responsible for all charges associated with importing the goods. We strongly suggest you check with your domestic customs agency to determine the charges prior to purchase. Pooldawg cannot issue credit in cases where packages are not delivered due to non-payment of fees.
b. Delivery Time: Estimated delivery times are provided for your convenience and are not guaranteed. Delays may occur due to factors outside of our control, such as carrier issues or weather.
c. Risk of Loss: The risk of loss and title for all items purchased from PoolDawg.com pass to you upon our delivery of the items to the carrier. We are not responsible for any items lost or damaged during transit.
4. Returns and Refunds
a. Return Policy: Please refer to our separate Return Policy page for detailed instructions on how to return a product. This policy is incorporated into these Terms by reference.
b. Damaged or Defective Items: If you receive a damaged or defective item, you must contact us within seven days of receipt to arrange for a return or exchange. Please see our issue resolution page to see how we can help if you received a damaged or defective item.
c. Refunds: Refunds will be processed to the original form of payment within 1 - 4 business days after we receive and inspect the returned item. Shipping costs are non-refundable.
5. Intellectual Property
a. Ownership: All content on this website, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of PoolDawg or its content suppliers and is protected by United States and international copyright laws.
b. Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and make personal use of this website. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
c. Trademarks: PoolDawg and other marks indicated on our site are registered trademarks or trade dress of PoolDawg. All other trademarks not owned by us that appear on this website are the property of their respective owners.
